Apple Sued For Covering iPhone 5 Fault
In December of last year iPhone users sued Apple Inc for a Wi-Fi defect that has cost customers over use of data fees.
Hagens Berman, a consumer rights law firm, have accused Apple Inc for purposely concealing a fault with their Wi-Fi.
Hagens Berman claim that Apple was made aware of the defect, and chose not to fix it or make it public knowledge.
The defect meant that AT&T wireless users and owners of iPhone 5 and 5s have been consistently charged data overage fees.
The defect causes AT&T iPhone 5 users to unknowingly switch from Wi-Fi and back onto cellular data.
This switch is reported to be automatic and unknown to the consumer.
How Has This Defect Been Found To Cost The Consumer?
This defect means that consumers are unknowingly using up their more expensive cellular data while believing their phones to be on Wi-Fi.
Falsely thinking they are connected to Wi-Fi means consumers are more likely to engage in data wasting activities on their iPhones such as watching or downloading videos.
This costs the consumer money, and unfairly so as they are unaware of it, says consumer rights law firm Hagens Berman.
What Has Apple Done To Fix The Defect?
The suit suggests that Apple knew about the defect almost immediately, yet did not let users know about the defect, knowingly costing AT&T subscribers and iPhone users money for an extended period of time. The law firm also claims that Apple did not fix the fault for AT&T subscribers for years, despite knowing about it.
In terms of an iPhone 5 repair of the issue, the defect was fixed in 2014 with the release of iOS 8.1, but Hagens and Berman say that does not absolve Apple Inc from knowingly costing their customers money for years due to a fault of their product.

Hagens and Berman say that Apple consumers need to be more aware of their rights as consumers.
So next time your iPhone 5 is playing up, who knows? You may not need an iPhone 5 repair after all – it could be on Apple.
